Green English is the operator of this website. In this website, the terms "we," "us," and "our" refer to Green English. Green English offers this website, including all information, tools, and services available from this site, to you, the user, on the condition that you accept all terms, conditions, policies, and notices stated here.
By accessing or using any part of this website, you agree to be legally bound by these Terms of Service. These Terms of Service apply to all users of this site, including, without limitation, users who are browsers, vendors, customers, merchants, and/or contributors of content.
We reserve the right to update, change, or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.
### SECTION 1 - GENERAL CONDITIONS ###
Welcome to Green English, which is owned and operated by T. Green and E. Green (Australian Business Number 22872790390). Upon enrolling in a course with Green English, you (“the Student”) are entering a legal agreement under common law, in which you agree to abide by the conditions of enrollment (including meeting stated payments), in exchange for the service offered by Green English during the course of enrollment. Terms of service are subject to the jurisdiction of the laws of Australia. These Terms of service form the agreement between Green English and the Student. It is the Student’s responsibility to fully read, understand and agree to all Enrollment Terms & Conditions, Privacy Statement and Fees & Charges upon enrollment. By agreeing to these Terms and Conditions and the Privacy Statement on the enrollment form, the Student confirms they have read, understood and agreed with the Terms and Conditions.
We reserve the right to decline service to any individual or entity for any reason at any time.
You understand that your content (not including credit card information) may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. We guarantee that credit card information is always encrypted during transfer over networks.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the service, use of the service, or access to the service or any contact on the website through which the service is provided, without express written permission from us.
By accepting these Terms of Service, you certify that you are of legal age in your country of residence, or that you are of legal age in your country of residence and have granted consent for any minor dependents to utilize this website.
### SECTION 2 - EXPECTATIONS AND CODE OF CONDUCT ###
All students are required to behave with respect for their classmates, the school staff, and school property. Any student who fails to do so in the eyes of the teacher may be excluded from the classroom and a complaint will be filed against him or her. Any complaints made against a student by any other student or member of staff will be investigated; and if the school decides that action is necessary, the student may be permanently excluded from the school. In your online and blended courses, you are expected to be an active participant in the course. You should be willing and ready to regularly communicate with classmates and instructors online. To maximize productivity, you are expected to complete all homework and assignments by the due date. Do not hesitate to ask questions. You are strongly encouraged to contact your instructor if you have course-related questions regarding course concepts, assignments and feedback provided to you.
### SECTION 3 - PRODUCTS OR SERVICES ###
Please note that certain products or services may only be available for purchase or delivery via the website.
We reserve the right to limit the sales of our products or services to any person, geographic region, or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice. We reserve the right to discontinue any product at any time.
Students can enroll to any of Green English’s programs at any time. There are no semester start dates. Students are considered to have commenced their course with Green English from the date they receive access to the digital platforms and study materials.
Platforms that we use for live classes, Speaking sessions, Writing correction etc. are Skype and/or Zoom, Teams. We may also contact you via email and/or Whatsapp. Group chats are used for interaction and peer-learning among students and run on Skype/Whatsapp/Teams.
We may also offer new services and/or features through the Site in the future (including the release of new tools and resources). Such new features and/or services will also be subject to these Terms of Service.
### SECTION 4 - BILLING AND ACCOUNT INFORMATION ###
Credit, Debit cards and Bank transfer payments are accepted in Australian dollars. Please ensure that we receive the full amount required, free of any payment system or intermediary bank charges.
We reserve the right to decline any order you submit to us. We reserve the right to limit or cancel quantities purchased per person or per order at our discretion. Such restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. If we make a change to or cancel an order, we will attempt to notify you by contacting the email address provided at the time the order was placed. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.
You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address, credit card numbers, and expiration dates, so that we can complete your transactions and contact you as needed.
All services require full prepayment.
Our services are available on a “per-unit” or “per-period” basis, according to your requirements. In the second case, the payment period (billing cycle) is four weeks. The four-week period represents a notional month of study. If the term "month" is referenced during communication, it shall be understood to signify a period of 4 weeks or 28 calendar days.
When a training course is purchased, the payment is charged on a subscription basis using Direct Debit. Please note that the first payment may differ when purchasing through the website or payment link. Subsequently, a link to the payment for an active subscription will be provided.
For the “per-unit” scheme, you can arrange your own payment plan to suit your needs (weekly, monthly, for a particular number of classes).
Subscriptions may be cancelled at any time.
### SECTION 5 - SUSPENSION AND NOTICE ON BEING ABSENT ###
Any student is eligible for a 14-day break a year without losing their place in a group/ their time slot in 1-1 tuition. There is no charge during this period. For family/personal circumstances, such as business/family travel, appropriate arrangements should be made in advance to allow learning online according to the usual timetable. We record all classes so students who miss classes can watch recordings and catch up with the group. If a student misses some classes outside the 14-day annual break, they are still charged for the classes they miss. With one-to-one tuition, students can reschedule any number of classes without extra charge provided they give a notice at least 24 hours prior to the agreed time. If there has been no notice or late notice of cancellation, a student will be charged the standard fee for that class.
### SECTION 6 - CANCELLATION AND REFUND POLICY ###
No Refunds.
Students can stop their training at any time without penalties. Students wishing to cancel their enrollment must submit notification of withdrawal in writing to their Student Support Officer. Student’s subscription and charges will remain active until Green English receives a notice of termination. If Student chooses to terminate their studies before the end of a course, a refund will not be issued.
All sales of services or digital goods are final. We do not offer refunds for any reason. Once a customer finalises a purchase, we consider the transaction complete, and no compensation will be provided.
Course Transfer.
It is possible to change your program at any time without penalties or extra charges. Green English will apply credit for money paid for the original enrollment against the new course. No refund will be issued for any difference in the course price.
### SECTION 7 - OPTIONAL TOOLS ###
We may provide you with access to third party tools over which we have no control or influence.
You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising out of or in connection with your use of any third-party optional tools.
### SECTION 8 - THIRD-PARTY LINKS ###
Certain content, products and services available through our Service may include materials from third parties.
Third-party links on this site or educational data may take you to third-party websites that are not affiliated with us. We are not responsible for reviewing or evaluating the content or accuracy of, and we do not endorse and have no liability or responsibility for, any third-party materials or websites or any other third-party materials, products or services.
We are not liable for any harm or damage related to the purchase or use of any goods, services, resources, content or other transactions made in connection with any third-party websites. Please carefully review and understand the policies and practices of the third party before engaging in any transaction. Complaints, claims, concerns or questions regarding Third Party products should be directed to the third party.
### SECTION 9 - AGE RESTRICTION ###
Enrollments will only be accepted for students 18 and over.
### SECTION 10 - PERSONAL INFORMATION ###
Green English is committed to protecting your privacy. We will make reasonable efforts to keep any such information that we have about you secure and to ensure that any of our employees or agents who have access to information about you do not make any unauthorised use, modification, reproduction or disclosure of that information. We use the information we collect about you to maximize the services that we provide to you. We collect and use your personal information to provide you with: technical support, billing, and credit control; promotions of suitable products and services, including upgrades and special offers. We might take photographs or videos for use in our promotional marketing purposes. You must inform us in writing before the course starts if you do not allow us to use such images. We will disclose your personal information, without notice or your consent, only if: we are required to do so by law or in the good faith belief that such action is necessary to conform with the laws, applicable code of conduct or legal process served on us in relation to our business or website; to protect and defend the rights or property of Green English; if we consider it necessary to do so in order to enforce or apply the terms of any of our agreements with you; if we sell our business or part of it; in extreme circumstances, to protect the personal safety of users of Green English services, its website, our staff or the public.
You might provide personal information through your participation in chat sessions, message boards, email exchanges or newsgroups accessed via Green English digital platforms, or another service provided by Green English. This information is public and immediately available to anyone who has access to such digital platforms; it is not private. Green English urges you to enter only information that you are comfortable to share with the public at large. This Privacy Policy does not apply to such information.
### SECTION 11 - ERRORS, INACCURACIES AND OMISSIONS ###
Occasionally, information on our site, our publication or the Service may contain typographical errors, inaccuracies or omissions, including but not limited to product descriptions, prices, promotions, offers, timeframes and availability. We reserve the right to correct any errors, inaccuracies or omissions and to change or update information or cancel orders if any information on the Service or any related website is inaccurate at any time without prior notice (including after you have submitted your order).
We are under no obligation to update, change or clarify any information on the Service or any related website, including, without limitation, pricing information, except as required by law. No stated update or revision date on the Service or any related website should be taken to mean that all information on the Service or any related website has been changed or updated.

You agree that we may from time to time indefinitely suspend the Service or terminate the Service at any time without notice to you.
You expressly agree that your use or inability to use the Service is at your sole risk. The Service and all products and services provided to you through the Service are provided (except as expressly stated by us) "as is" and "as available" for your use without any representations, warranties, or conditions of any kind, either express or implied, including any implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
In no event shall Green English Online, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation, lost profits, lost revenues, lost savings, loss of data, replacement costs, or any similar damages, whether based on contract, tort (including negligence), strict liability, or otherwise, arising out of or in connection with the use of or reliance on the information or materials contained on the site, whether based on contract, tort (including negligence), strict liability or otherwise, arising out of or in any way connected with your use of the Service or any products purchased through the Service, including but not limited to any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Service or any content (or product) posted, transmitted or otherwise made available through the Service, even if advised of the possibility thereof. Every attempt is made to ensure all information provided by Green English is accurate, and that the Student has attained all competencies taught within a course. Students are responsible for their use and maintenance of acquired competencies. Green English takes no responsibility for, and will not be liable, for any action or claim in connection with, or arising from any such information, instruction or advice, given by any student or ex-student. Green English takes no responsibility for and will not be liable for the Student’s or ex-Student’s interpretation and/or misuse of instruction and/or materials. All information, texts, materials, graphics, software and advertisements on the Site and our educational data (“Content”) are protected by Australian and international copyright and trademark laws. No courses, course materials, videos and study notes are to be republished, reproduced, or used in any way outside the pursuit of studying the course by the enrolled Student without explicit permission granted in writing by Green English.
### SECTION 14 – INDEMNIFICATION ###
You agree to indemnify and hold Green English Online and its parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third party.
### SECTION 15 – SEVERABILITY ###
If any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, such provision shall nevertheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severable from these Terms of Service, and such determination shall not affect the validity and enforceability of any remaining provisions.
### SECTION 16 – TERMINATION ###
The obligations and liabilities of the parties that arose prior to the termination date shall survive the termination of this Agreement for all purposes.
These Terms of Service will continue in effect unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our services or by ceasing to use our site.
If, in our sole discretion, you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we may also terminate this Agreement at any time without notice, and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly, we may deny you access to our Services (or any part thereof).
